Driveway Construction

Council's authority to approve driveway construction is outlined in the Roads Act 1993, which states that, "a person must not erect a structure or carry out a work in, or over a public road...otherwise than with the consent of the appropriate authority," and that the "owner of land adjoining a public road is liable ... for the construction and repair of any special crossing over a footway to or from the land.".

If you are constructing a driveway in conjunction with a Development, Council may withhold the Damage Bond if the driveway is not constructed to Council standards.

Please note that driveway construction must be carried out by a licensed contractor.

Driveway Policy

Council's Vehicle Crossings Policy may be updated from time to time.  The policy current at the time that the Driveway Levels Application is assessed will apply.

Application to Install a Driveway

To ensure correct construction of a driveway takes place, you are required to lodge either a Rural Driveway Application form or an Urban Driveway Application form, depending on which planning zone your property is located in. The application form is to be completed and returned to Council with a plan of the proposed driveway and the required fee.

If you are constructing multiple driveways to commercial and residential flat properties, you will be required to pay an application fee for each proposed driveway.

Once you have submitted the relevant Driveway Application form with a plan of the proposed driveway and required application fee, the Technical Officer will conduct a site inspection to review the details presented in your application. You will then be issued a letter giving approval for you to begin construction of the driveway, and providing you with relevant Council Standards, conditions and driveway levels for construction.

If your driveway application is not approved, you will be contacted by the Technical Officer for further discussion.
